HUNTINGTON – A man is suing DSV Express Inc. after he claims it is responsible for a car accident that caused him injury.
Komil Shiraliev was also named as a defendant in the suit.
On Oct. 4, 2014, David Dolen was traveling west on Interstate 64 in the right lane of traffic near Huntington when a tractor trailer owned by DSV Express and driven by Shiraliev, attempted to change lanes and began moving the tractor trailer into Dolen’s lane of travel, according to a complaint filed Aug 31 in Cabell Circuit Court.
Dolen claims as a result, Shiraliev struck his vehicle and forced his vehicle into the guardrail and cement wall on the right side of the road.
DSV is vicariously liable for Shiraliev’s actions pursuant to the theories of principal/agency and respondent superior, according to the suit.
Dolen claims Shiraliev was negligent, careless and his conduct caused the collision and caused him to suffer severe injuries to his body, as well as medical expenses; pain and suffering; physical limitations; a diminished capacity to enjoy life; annoyance and inconvenience; and other consequences.
Dolen is seeking compensatory and punitive damages. He is being represented by Robert D. Cline Jr., Robert A. Campbell and R. Chad Duffield of Farmer, Cline & Campbell.
The case is assigned to Circuit Judge F. Jane Hustead.
