Customer blames Walmart store for injuries

LOGAN — A Mingo County woman is suing Walmart, alleging the defendant's negligence led to the plaintiff suffering injuries in a fall. 

Amanda DeBoard of Delbarton filed a lawsuit Sept. 23 in Logan Circuit Court against Wal-mart Stores East LP, doing business as Walmart Supercenter alleging breach of duty in failing to maintain a safe premises.

According to the complaint, on Sept. 2, while  DeBoard was shopping at a Walmart Supercenter in Logan, she stepped on a slippery substance, causing her to fall backward. The suit says DeBoard sustained serious injuries to her head, neck, shoulder, back and knee, resulting in pain and suffering, mental anguish, medical expenses and other monetary damages. 

The plaintiff alleges Walmart Supercenter failed to adequately inspect its premises to discover hazardous conditions and failed to remedy or eliminate the dangerous condition.

DeBaord seeks trial by jury, damages, litigation costs and expenses, and all other relief. She is represented by attorney Jeffrey S. Simpkins of Simpkins Law Office PLLC in Williamson.
