Office manager alleges former employer breached contract

WHEELING — An Ohio County man is suing his former employer, alleging breach of employment contract.

Zachary Costanzo filed a lawsuit Sept. 23 in Ohio Circuit Court against EMS USA Inc. alleging breach of of the Wage Payment and Collection Act.

According to the complaint, Costanzo has suffered and continues to suffer monetary damages as a result of not being able to obtain gainful employment and the need to retain counsel to pursue this matter.

The plaintiff alleges EMS USA eliminated his 401K benefits, reduced his auto allowance and other benefits, failed to timely pay his PTO, interfered with his prospective business relationship with a prospective employer and terminated his employment Aug. 16.

Costanzo seeks trial by jury, declaration the non-competition covenant in unenforceable, all damages and all other relief deemed appropriate. He is represented by attorneys Jeffrey A. Ray and Julie R. Shank of Bowles Rice LLP in Morgantown and Wheeling.
