GRAFTON — A Grafton man is suing a Fairmont credit union, a creditor, alleging deceptive business practices.
Jarod A. Newbraugh filed a class action complaint, individually and on behalf of all others similarly situated, Sept. 23 in Taylor Circuit Court against Fairmont Federal Credit Union, alleging violation of the West Virginia Consumer Credit and Protection Act.
According to the complaint, as a result of defendant's conduct, Newbraugh was caused to suffer monetary damages. The plaintiff alleges Fairmont Federal Credit Union intentionally misrepresented the amount of debt being collected and employed a illegal lawsuit debt collection policy.
Newbraugh seeks trial by jury, an order certifying this case as class action, appointing plaintiff and his counsel as representatives, damages and any further relief that is appropriate.
