Couple blames Wheeling hotel owner for husband's fall

WHEELING — A Pennsylvania couple is suing a Wheeling hotel owner, alleging the defendant's negligence led to injuries for the husband. 

Henry Flannigan Jr. and Joye G. Flannigan of Monongahela, Pennsylvania, filed a lawsuit Sept. 29 in Ohio Circuit Court against Wheeling Island Gaming Inc., alleging failure to keep its premises in a safe condition.

According to the complaint, on Dec. 11, 2105, Henry Flannigan was at Wheeling Island, The Buffet. The suit says as he was walking to a table he slipped and fell due to a foreign substance on the floor. 

As a result of the defendant's negligence, the lawsuit states, Flannigan suffered injuries, including a fracture of the anterior tibial spine, severe pain and emotional distress, disability, medical expenses and loss of income. Joye Flannigan, the suit states, suffered loss of consortium, service and companionship. The plaintiffs allege Wheeling Island Gaming failed to warn its guests of the dangerous condition and failed to remove the dangerous condition.

The Flannigans seek trial by jury, plus judgment in their favor and against the defendant. They are represented by attorneys Kristen Moritz and Jonathan M. Gesk of Gesk Moritz LLC in Carnegie, Pennsylvania
