Shopper alleges she was injured by carts at Cross Lanes Kroger

CHARLESTON – A Cross Lanes woman alleges she was injured by shopping carts while shopping at a grocery store.

Jo Ann Gore filed a complaint in the U.S. District Court for the Southern District of West Virginia against The Kroger Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 4, 2015, she was a customer at defendant's store located in Cross Lanes when she was struck by moving shopping carts that caused her fall and sustain injuries. She alleges the incident resulted in medical expenses of more than $70,000, physical and mental pain, annoyance and inconvenience. The plaintiff holds The Kroger Co. responsible because the defendant allegedly negligently designed and constructed the salon doors creating a double blind intersection of moving shopping carts and shoppers.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount to be determined at trial, attorneys' fees and interest. She is represented by Guy R. Bucci of Bucci & Lynch in Charleston and F. Albert Sines Jr. and Victoria L. Casey of in Charleston.
