Field supervisor accuses county board, assessor of retaliatory discharge

NEW MARTINSVILLE — A New Martinsville man is suing the Wetzel County Commission and an assessor, alleging hostile work environment, retaliation and wrongful termination.

Eric Burke filed a lawsuit Sept. 29 in Wetzel Circuit Court against the Wetzel County Commission and Scott Lemley, alleging violations of the West Virginia and the U.S. constitutions.

According to the complaint, upon Burke's return to work as a field supervisor from FMLA leave following surgery, he was subjected to unlawful harassment, discriminatory treatment and retaliatory discharge due to his medical condition. 

The plaintiff alleges the defendants failed to return him to his pre-leave duties, suspended him from work, created an intimidating, hostile and abusive working environment and terminated his employment July 11.

Burke seeks trial by jury, judgment against the defendants in an amount to fully compensate him for his monetary injuries, losses and damages. He is represented by attorney Jeffrey A. Grove of Grove, Holmstrand & Delk PLLC in Wheeling.
