Pack line worker accuses former employer of discrimination

WHEELING — A Marshall County man is suing his former employer, alleging discrimination and wrongful or constructive eviction.

Donald T. Boggess filed a lawsuit Aug. 30 in U.S. District Court for the Northern District of West Virginia against Warren Distribution Inc. alleging violation of the West Virginia Human Rights Act.

According to the complaint, Boggess worked for Warren Distribution from April 25, 2011 until Sept. 5, 2014, when he was terminated from his employment as a pack line worker. The suit says this resulted in lost wages and benefits and emotional distress. 

The plaintiff alleges Warren Distribution subjected him to discrimination and harassment by making his working condition so intolerable that it was reasonable enough for him to leave employment.

Boggess seeks trial by jury, compensatory damages, punitive damages, attorney fees, costs, reinstatement and all other relief. He is represented by attorney David L. Delk of Grove, Holmstrand & Delk PLLC in Wheeling.
