Customer accuses Dodge dealer of deceptive practices

RIPLEY — A Jackson County man is suing a Dodge manufacturer, dealer and lender, alleging breach of contract and breach of warranty.

James Pauley filed a lawsuit Oct. 3 in Jackson Circuit Court against FCA US LLC, I-77 Auto Group Inc. and BB&T Corp., alleging they violated the West Virginia Consumer Credit and Protection Act.

According to the complaint, on April 27, Pauley purchased a 2016 Dodge Ram 1500 for personal use. After purchase, the suit says, Pauley discovered defects and experienced non-conformities with the vehicle. The defects, the lawsuit states, substantially impaired the use, value and safety of the Dodge Ram. 

The plaintiff alleges the defendants failed to repair the Dodge to bring the vehicle into conformity with its warranties and also failed and refused to provide a comparable replacement.

Pauley seeks trial by jury, cancellation of the contract by revocation of acceptance, damages in an amount to be determined at trial, pre- and post-judgment interest, and all other general relief.
