Customer alleges Kroger breached contract settlement

MOUNDSVILLE — A Glen Dale woman is suing Kroger, alleging failure to comply with a settlement contract.

Isolde M. Helms filed a lawsuit Sept. 30 in Marshall Circuit Court against The Kroger Co., Kroger Limited Partnership 1, John Doe and John Doe Corp., alleging breach of contract. 

According to the complaint, on Sept. 30, 2014, Helms was injured while shopping at defendant Kroger's grocery store in Moundsville. On Sept. 29, 2016, the suit says, Helms and Kroger entered into a settlement agreement for the plaintiff's claim for $15,000. 

The lawsuit states Helms sustained monetary damages for her inability to receive the settlement money. The plaintiff alleges the defendants have failed and refused to issue the full payment for the settlement.

Helms seeks trial by jury, an order to uphold and enforce the Sept. 29 agreement, compensatory damages, costs of court, attorney fees and all other relief. She is represented by attorney Teena Y. Miller of Gold, Khourey & Turak LC in Moundsville.
