MSI Lodging Systems LLC and Koneta Vanhoose Parsley were also named as defendants in the suit.
Charlotte F. Marcum was employed by the defendants as a housekeeper and earned approximately $8.75 per hour, according to a complaint filed Aug. 18 in Mingo Circuit Court.
Marcum claims on Sept. 16, 2015, she suffered a workplace injury and confided to Donna Caudill about the injury.
Sometime after the accident, Patty Fouch, the head housekeeper and Marcum’s supervisor, had a conversation with her in which she advised her to seek treatment for her injuries, according to the suit.
Marcum claims Fouch and/or Caudill informed Parsley of the accident and, after she notified the defendant of her injury, she was never placed back on the work schedule.
The defendants hired subsequent housekeepers that were substantially younger after Marcum suffered the workplace injury, according to the suit.
Marcum claims the defendants violated West Virginia code and the West Virginia Human Rights Act.
The defendants discriminated and retaliated against Marcum and wrongfully terminated her employment, according to the suit.
Marcum is seeking compensatory and punitive damages. She is being represented by Nathan D. Brown and Joshua S. Ferrell of Ferrell & Brown PLLC.
The case is assigned to Circuit Judge Miki Thompson.
