FAYETTEVILLE — A West Virginia couple is suing health care providers, alleging deceptive representations.
Thomas W. Buckland and Linda F. Buckland filed a lawsuit Oct. 4 in Fayette Circuit Court against Oak Hill Hospital Corp., doing business as Plateau Medical Center and Professional Account Services Inc., alleging violation of the West Virginia Consumer Credit and Protection Act.
According to the complaint, in 2015, the Bucklands began receiving collection calls and letters from the defendants concerning an alleged debt. The suit says the defendants' unfair collection practices caused the Bucklands to be upset, annoyed, angered, harassed and inconvenienced.
The plaintiffs allege the defendants engaged in unreasonable, oppressive and abusive collection practices by using an electronic communications device.
The plaintiffs seek trial by jury, actual damages, statutory damages, attorney fees, court costs and expenses and all other relief the court deems just and proper. They are represented by attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.
