Injured employee accuses coal business of wrongful termination

BECKLEY — A Lincoln County man is suing a coal business, alleging discrimination and wrongful termination.

Jeremiah Adkins filed a lawsuit Oct. 4 in Raleigh Circuit Court against Elite Coal Services LLC, violation of the West Virginia Code.

According to the complaint, on May 9, 2015, Adkins he was terminated from employment at Elite Coal's Allen Powellton mine when he filed a workers' compensation claim after he was injured on the job. The plaintiff alleges Elite Coal Services failed to provide workers compensation benefits, discriminated against Adkins, terminated his employment and refused to reinstate him to his job.

Adkins seeks trial by jury, all damages, reinstatement to his job, attorney fees and court costs, plus all other relief the court deems just and proper. He is represented by attorneys J.
