Wayne County couple blames Marshall board for husband's injuries

HUNTINGTON — A Wayne County couple is suing Marshall University, alleging the defendant's negligence resulted in injuries to the husband. 

John Moore and Shirley Moore filed a lawsuit Oct. 5 in Cabell Circuit Court against the Marshall University Board of Governors, alleging the defendants employed a physician who failed to provide proper medical treatment.

According to the complaint, as a result of the negligence of Marshall University employee Dr. Dustin Robinson, John Moore suffered great pain, facial paralysis, nerve injury, muscle injury, additional surgery and medical expenses, lost wages and a delay in the diagnosis and treatment of his cancer in 2014. 

The plaintiffs allege Robinson failed to follow the accepted standard of medical care and deprived plaintiff Moore of a chance of immediate recovery.

The Moores seek trial by jury, judgment in excess of the minimum requirements of the court and all other relief as is proper. They are represented by attorneys Tony L. O'Dell and Cheryl A. Fisher of Tiano O'Dell PLLC in Charleston.
