HUNTINGTON — A West Virginia woman is suing an in-state debt collector, alleging intentional infliction of emotional distress and violation of telephone harassment statutes.
Deborah Hale filed a lawsuit Oct. 7 in Cabell Circuit Court against Cashcall Inc., alleging violation of the West Virginia Consumer Credit and Protection Act.
According to the complaint, when Hale fell into arrears upon her alleged debt, she began to receive telephone calls from Cashcall attempting to collect the alleged debt.
As a result of defendant's actions, the suit says Hale was annoyed, harassed, bothered and abused. The plaintiff alleges Cashcall engaged in unreasonable and/or abusive conduct in attempting to co-collect a debt and failed to disclose the name of the business entity making the demand for the money.
Hale seeks trial by jury, compensatory, actual, punitive and statutory damages, costs of litigation and any other relief the court deems proper. She is represented by attorneys Matthew P. Stapleton and Scott Stapleton of Stapleton Law Offices in Huntington.
