Man alleges American Express Co. invaded privacy with phone calls

HUNTINGTON – A consumer claims a financial company allegedly caused intentional infliction of emotional distress and invaded his privacy with numerous telephone calls.

Jeffrey Todd Welch filed a complaint on Oct. 19 in Cabell Circuit Court against American Express Co. alleging that the debt collector violated the West Virginia Credit and Protection Act, negligence and other counts.

According to the complaint, the plaintiff alleges that when he fell in arrears upon an alleged debt, he began receiving collection calls from defendant in an attempt to collect. The plaintiff holds American Express Co. responsible because the defendant allegedly continued attempting to collect the alleged debt directly from the plaintiff even after being notified that plaintiff is represented by a lawyer and to contact the attorney instead.

The plaintiff seeks compensation for all damages, attorney's fees and court costs, and all other relief as the court deems proper. He is represented by Matthew P. Stapleton of Stapleton Law Offices in Huntington. The case has been assigned to Circuit Judge Paul T. Farrell.
