GM hit with lawsuit over defective vehicle that led to a death

CHARLESTON — A father and mother are suing General Motors LLC, a car manufacturer, citing alleged breach of implied warranty.

Jerry R. Watts and Debbie R. Watts, as administratrix of the estate of Joseph C. Watts, filed a complaint on Oct.19, in the U.S. District Court for the Southern District of West Virginia against General Motors LLC alleging that the car manufacturer designed and manufactured a vehicle with mechanical defects.

According to the complaint, the plaintiffs allege that, in Sept. 8, 2014, decedent Joseph Watts was operating a 2002 Pontiac Grand Am when he experienced a defect in the ignition of the vehicle that caused it to lose power, brakes and steering, which caused him to cross the center lane and strike a vehicle head on. As a result, he sustained severe injuries that eventually led to his death. The plaintiffs hold General Motors LLC responsible because the defendant allegedly negligently placed the subject vehicle in the market without inspecting the defects and falsely warranted that the vehicle was fit as a private passenger vehicle.

The plaintiffs request a trial by jury and seek judgment against defendant for compensatory damages, together with costs, pre- and post-judgment interest. They are represented by Donald R. Jarrell of Donald R. Jarrell Law Offices in Wayne.
