Woman allege Schneider driver struck vehicle in Beaver parking lot

BECKLEY – A Raleigh County couple are suing a trucking company and its driver after a collision at a fueling station.

Nancy C. Ford and Darrell B. Ford filed a complaint on Oct. 14 in Raleigh Circuit Court against Schneider National Carriers Inc. and Brandon Patrick Hawkins alleging negligence.

According to the complaint, the plaintiffs allege that on Oct. 19, 2014, Nancy Ford was parked in the parking lot of Shell Fueling Station in Beaver when Hawkins, who was operating a tractor-trailer owned by Schneider, was turning around and struck her vehicle, causing her to sustain severe injuries to her body. The plaintiffs allege Nancy Ford suffered mental pain, loss of service and companionship, and incurred necessary medical expenses.

The plaintiffs holds Schneider National Carriers Inc. and Hawkins responsible because Hawkins allegedly failed to properly negotiate the turn of the tractor-trailer and failed to see what he should have seen.

The plaintiffs request a trial by jury and seek relief from defendants for compensatory damages, punitive damages, pre- and post-judgment interest, attorney's fees and costs for the action and all other and further relief. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
