Church trustees claim waste water treatment plant caused property damage

PRINCETON — Church trustees are suing The Sanitary Board of Bluefield, a waste water treatment plant owner, citing alleged insufficient measures were taken to prevent property damage.

Jeff Branham, Richard Branham, Jeff Pennington and Robert Remines, trustees of the Community Baptist Church, filed a complaint on Oct. 7, in the Mercer Circuit Court against The Sanitary Board of Bluefield alleging that the waste water treatment plant owner negligently set up a waste water line on the church property.

According to the complaint, the plaintiffs allege that the church sustained property damage because the defendant's sewer line was set up on the church property and would not properly function to remove waste water. The plaintiffs holds The Sanitary Board of Bluefield responsible because the defendant allegedly failed to operate its temporary pump and temporary waste water line that was much smaller than the standard and failed to install a properly working pump that would remove the waste water.

The plaintiffs request a trial by jury and seek judgment against defendant in an amount sufficient to compensate the damages and injuries sustained by the church, with interest, attorney's fees and costs, and any other relief as the court deems proper. They are represented by Anthony R. Veneri of Veneri Law Offices in Princeton.
