Winfield — A RV vehicle dealership is suing Greatamerica Financial Services Corp. and Greatamerica Leasing Corp., equipment financing companies, citing alleged unlawful telephone equipment leasing scheme.
Burdette Camping Center Inc. filed a complaint on Oct. 7, in the Putnam Circuit Court against the defendants alleging that they violated the Uniform Declaratory Act.
According to the complaint, the plaintiff alleges that it sustained damages for entering into a telephone equipment leasing without warranties and it would not own the telephone equipment after leasing. The plaintiff holds Greatamerica Financial Services Corp. and Greatamerica Leasing Corp. responsible because the defendants allegedly misrepresented that plaintiff was entering into a standard telephone equipment leasing agreement, collected and continues to attempt to collect from plaintiff what plaintiff does not owe to defendants and disclaimed any obligation to repair any of the telephone equipment.
The plaintiff requests a trial by jury and seeks declaration that the purported agreement is unenforceable, an order to return to plaintiff all payments made to the said agreement, award for punitive damages, judgment interest and all other relief it is entitled.
