Investors file suit against Budget Finance Co. for alleged securities law violations

NEW MARTINSVILLE — Investors are suing Budget Finance Co., Donna Brown, the estate of Carolyn Welch, River Rentals inc., Carla Knapp and Sharon Midcap, multiple entities, citing alleged fraud and breach of fiduciary duty.

Greg Beall, Jill Beall, Charles Fluharty, Joyce Fluharty, Amanda Patrello, Christopher Roupe, et al filed a complaint on Oct. 11, in the Wetzel Circuit Court against the defendants alleging that they violated the West Virginia Uniform Securities Act.

According to the complaint, the plaintiffs allege that Greg Beall, Jill Beall, Charles Fluharty, Joyce Fluharty, Amanda Patrello, Christopher Roupe, et al suffered monetary losses for not receiving their unconditionally guaranteed monthly interest income nor they have been able to withdrew their capital investments. As a result, they also suffered annoyance, emotional distress and embarrassment. The plaintiffs holds Budget Finance Co., Donna Brown, the estate of Carolyn Welch, River Rentals inc., Carla Knapp and Sharon Midcap responsible because defendant Budget Finance allegedly closed abruptly without warning them and despite an order from the acting commissioner of the Division of Financial Institutions it has not re-opened for business. Defendants Budget Finance and River Rentals allegedly transferred assets to each other without receiving equivalent value.

The plaintiffs request a trial by jury and seek judgment against the defendants for compensatory damages, punitive damages, interest, attorneys' fees, expenses and costs and such other relief as the court deems proper. They are represented by Scott S. Blass, Jason E. Causey and Bryan D. Pasciak of Bordas & Bordas PLLC in Wheeling.
