Comcast subscriber alleges services were disconnected for amounts she didn't owe

WHEELING – An Ohio County woman alleges her services were frequently disconnected for debts that were not owed.

Kimberly Weir filed a complaint on Oct. 25 in Ohio Circuit Court against Comcast Cable Communications Management LLC alleging that the cable and internet provider violated the West Virginia Consumer Credit & Protection Act, unfair debt collection and other counts.

According to the complaint, the plaintiff entered into a service contract with the defendant for cable, security, internet and telephone services in 2014. She alleges the billing was inaccurate and misleading and that she tried to resolve the issue with the defendant through writing and by phone. The suit states the defendant disconnected the plaintiff's services several times for payment that was not due.

The plaintiff holds Comcast Cable Communications Management LLC responsible because the defendant allegedly disconnected her services for failing to pay amounts that were not due, charged her with reconnection fees and continues to collect and attempted to collect amounts that are not due.

The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, penalties, attorneys' fees, pre- and post-judgment interest and any other relief. She is represented by James G. Bordas Jr. and Jason E. Causey of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
