KINGWOOD – A human resources employee at Hopemont Hospital alleges she was retaliated against for reporting sexual harassment she observed.

Brenda L. Thomas filed a complaint on Oct. 17 in Preston Circuit Court against West Virginia Department of Health and Human Resources alleging that the employer violated the West Virginia Whistleblower Act.

According to the complaint, the plaintiff alleges that as a result of defendant's actions, she suffered emotional distress that manifested in severe hypertension and physical afflictions that required her to take Family Medical Leave Act leave.

The plaintiff holds West Virginia Department of Health and Human Resources responsible because the defendant allegedly subjected her to discrimination, retaliation and disparate and adverse employment actions for reporting and opposing sexual harassment allegedly perpetuated by Hopemont Hospital's administrators.

The plaintiff requests a trial by jury and seeks compensation for all damages, out-of-pocket losses, pre- and post-judgment interest, costs of litigation and such other relief as the court deems appropriate. She is represented by Sean W. Cook of Meyer Ford & Glasser PLLC in Charleston. The case has been assigned to Circuit Judge Lawrance S. Miller Jr.
