Quorum Federal Credit Union accused of calling couple after they revoked consent

PINEVILLE – An Oceana couple alleges a credit union has harassed them with phone calls.

Richard Paynter and Karina Paynter filed a complaint on Oct. 17 in Wyoming Circuit Court against Quorum Federal Credit Union alleging that the debt collector violated the West Virginia Consumer Credit Protection Act, the Telephone Consumer Protection Act and other counts.

According to the complaint, the plaintiffs allege that between June 3 and July 8 they received no less than 78 calls to their cellular telephones after mailing the defendant a letter on June 1 revoking their permission for it to contact them. As a result, they allege they have been annoyed, aggravated and inconvenienced. The plaintiffs holds Quorum Federal Credit Union responsible because the defendant allegedly made calls using an automatic telephone dialing system and artificial with the intent to annoy or harass the plaintiffs.

The plaintiffs request a trial by jury and seek judgment against defendant for actual and punitive damages, attorney's fees, costs and any other relief as the court deems appropriate. They are represented by Paul W. Roop II of Roop Law Office LC in Beckley. The case has been assigned to Circuit Judge Warren R. McGraw.
