Former employee accuses coal producers of breach of contract

BECKLEY — A former employee is suing Raleigh County coal producers, alleging breach of employment contract.

Christopher Keffer filed a lawsuit Oct. 20 in Raleigh Circuit Court against Pocahontas Coal Company LLC and United Coal Company LLC, doing business as Metinvest, alleging violation of the West Virginia Wage Payment and Collection Act.

According to the complaint, upon cessation of Keffer's employment, his monies under the loyalty reward plan program become due. The suit says his benefits for the program have been denied. 

The plaintiff alleges the defendants failed and refused to pay his reward plan bonus.

Keffer seeks trial by jury, declaratory judgment that the loyalty reward plan is a wage and/or fringe benefit, all monies owed, liquidated damages, attorney fees and costs and all other relief the court deems appropriate. He is represented by attorneys Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville, and by J.C. Powell of Powell & Majestro PLLC in Charleston.
