Harrison County worker accuses state agency, supervisor of wrongful discharge

CHARLESTON — A Harrison County man is suing a West Virginia state agency and a supervisor, alleging a hostile work environment, sexual harassment and wrongful discharge.

Timothy W. Hodge Jr. filed a lawsuit Oct. 11 in Kanawha Circuit Court against the West Virginia Department of Environmental Protection and Tonya Mather, alleging violation of the West Virginia Human Rights Act.

According to the complaint, on Feb. 1, Hodge was terminated from his employment, causing him to suffer loss of wages and fringe benefits. 

The plaintiff alleges Mather created a hostile work environment, engaged in retaliation and reprisal against him because of his refusal to have sex with her and routinely engaged in foul language in the workplace.

Hodge seeks trial by jury, judgment against each defendant for all damages, reinstatement, attorney fees, court costs and all other relief as is appropriate. He is represented by attorney Walt Auvil of The Employment Law Center PLLC in Parkersburg.
