CHARLESTON – A Wood County man alleges he was not hired for a job because of his age.
James A. Riffle filed a complaint on Oct. 17 in the Kanawha Circuit Court against Turnoutz LLC and Larry Marcum alleging that they violated the West Virginia Human Rights Act.
According to the complaint, the plaintiff alleges that his former employer of approximately 20 years, Cross America Partners LP, entered into an agreement whereby defendant would lease and operate their 41 convenience stores. As a result, his position ceased to exist, the suit states, and was not hired by the defendant. The plaintiff holds Turnoutz LLC and Marcum responsible because the defendants allegedly hired younger and less-qualified individuals for the plaintiff's former position as well as other positions he was qualified.
The plaintiff requests a trial by jury and seeks award for all damages, prejudgment interest, attorney's fees, costs and such other just and equitable relief. He is represented by Paul L. Frampton Jr. of Atkinson & Polak PLLC in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
