RIPLEY – A Ravenswood consumer is suing a financing company over allegations it made misleading representations regarding an account to finance a vehicle.
Benji Jewell filed a complaint on Oct. 13 in Jackson Circuit Court against Credit Acceptance Corp. alleging misrepresentation in debt collection, unconscionable debt collection and breach of contract.
According to the complaint, the plaintiff alleges that on March 25, 2013, he purchased a 2005 Volkswagen Passat, financed by defendant. The suit states payments were made on the debt via automatic withdrawal but beginning in September 2014, the defendant began making erratic withdrawals and redeposits to the plaintiff's checking account. In September 2015, he alleges he began receiving calls from defendant telling him that he was behind in payments. The plaintiff holds Credit Acceptance Corp. responsible because the defendant allegedly made multiple withdrawals in excess of the payments due.
The plaintiff requests a trial by jury and seeks award for all damages, and such other relief as the court deems just and equitable. He is represented by Loree Stark of Mountain State Justice Inc. in Charleston.
