Man sues R. Davis Trucking for accident injuries

PRINCETON – A man is suing R. Davis Trucking after he claims a car accident caused him damages and injuries.

Randy Davis, the owner of R. Davis Trucking; and Ralph Kennedy Conley were also named as defendants in the suit.

On Feb. 3, James J. Jackson was operating his commercial vehicle in wet conditions on Interstate 77 near Flat Top and was heading in a southerly direction in the right-hand lane of travel, carefully proceeding at a slow rate of speed due to extreme fog, with his flashers activated to signal other users that he was driving below the speed limit, according to a complaint filed July 25 in Cabell Circuit Court and transferred to Mercer Circuit Court on Oct. 25

Jackson claims Conley, who was operating a vehicle owned by Davis and/or R. Davis Trucking loaded with hazardous materials, when Conley drove the vehicle in such a manner as to strike the plaintiff’s vehicle.

Conley’s vehicle struck Jackson in a sideswiping fashion, then veering to the left and striking another tractor trailer in the left lane, before again striking Jackson, according to the suit.

Jackson claims Conley was operating his vehicle at an unsafe speed due to the heavy fog and wet road conditions and negligently failed to maintain a proper lookout for slow moving vehicles with flashers activated.

As a direct and proximate cause of the defendants’ negligence, Jackson suffered injuries and property damage, according to the suit.

Jackson is seeking compensatory damages with pre- and post-judgment interest. He is being represented by James D. McQueen Jr. of McQueen Davis PLLC.
