BECKLEY – A bank alleges three Raleigh County companies have defaulted on their loans.
Branch Banking and Trust Co. filed a complaint on Oct. 24 in Raleigh Circuit Court against A P & E Properties LLC, Appalachian Paving and Aggregate LLC and Beckley Asphalt and Aggregate LLC alleging that they failed to perform their obligations under the commercial promissory notes.
According to the complaint, the plaintiff alleges that it entered into commercial promissory notes with the defendants. The plaintiff holds A P & E Properties LLC, Appalachian Paving and Aggregate LLC and Beckley Asphalt and Aggregate LLC responsible because the defendants allegedly defaulted under the terms of the notes by failing to make payments when due.
The plaintiff requests a trial by jury and seeks judgment be entered in its favor for payment of all unpaid debts, post-judgment interest, attorneys' fees and for such other just and equitable relief. It is represented by James W. Lane Jr., Bradford P. Bury and Mitchell B. Tuggle of Flaherty Sensabaugh Bonasso PLLC in Charleston. The case has been assigned to Circuit Judge John A. Hutchison.
