Bailey Hardwoods LLC, Cedar Creek LLC accused of selling defective residential paneling

WEBSTER SPRINGS – A consumer alleges pine paneling he purchased for indoor use was defective.

Joseph Dyer filed a complaint on Oct. 24 in Webster Circuit Court against Bailey Hardwoods LLC and Cedar Creek LLC alleging breach of sales agreement, breach of warranty of fitness and other counts.

According to the complaint, the plaintiff alleges that he bought indoor residential pine paneling from the defendants. After the paneling was installed, the plaintiff alleges it began to shrink, warp and crack. He alleges the product sold by the defendants was defective and non-conforming for its intended use. The plaintiff holds Bailey Hardwoods LLC and Cedar Creek LLC responsible because the defendants allegedly supplied paneling that was not fit for the purpose for which it was to be used.

The plaintiff requests a trial by jury and seeks monetary award for all damages, costs for this action and for such other just and equitable relief. He is represented by Dan L. Hardway in Cowen.
