CLARKSBURG — A Harrison County man is suing Lewis County psychiatric facility operators, alleging intentional infliction of emotional distress and violation of civil rights.
Douglas Otto Fischer filed a lawsuit Oct. 25 in U.S. District Court for the Northern District of West Virginia Clarksburg Division against Dr. Cheryl Hill, Dr. Abdel Massoud, William R. Sharpe Jr. Hospital and Kimberly Walsh, alleging violation of the the Eighth and Fourteenth Amendments to the U.S. Constitution.
According to the complaint, as a direct and proximate result of the defendants' actions, Fischer, who had been committed to Sharpe Hospital after being charged with two felonies and a misdemeanor, has suffered deprivation of liberty, mental and emotional distress, humiliation, inconvenience and other compensatory damages.
The plaintiff alleges the defendants recommended his continued commitment to Sharpe Hospital without due process of law and dispossessed and meddled with his personal property.
Fischer seeks trial by jury, compensatory and punitive damages, attorney fees and court costs, plus all relief to which he is entitled. He is represented by attorney Jason T. Gain of Bridgeport.
