Property owner alleges power company owes $12,000

WEBSTER SPRINGS — A Webster County property owner is suing a power company, alleging breach of a lease agreement in owing $12,000.

J.C. Baker & Sons Inc. filed a lawsuit Oct. 27 in Webster Circuit Court against Monongahela Power Company, alleging the defendant failed to perform its duties under the lease agreement.

According to the complaint, J.C. Baker & Sons leased its property to Monongahela Power for a term of five years ending May 31, 2017 for $3,000 per month. Starting July 1, 2016, the suit says, the plaintiff has not received monthly rent totaling $12,000. 

The plaintiff alleges Monongahela has refused to make the rent payment for the past four months.

J.C. Baker & Sons seeks trial by jury, judgment of $12,000, plus costs, attorney fees, pre and post-judgment interest, all rents that becomes due after this filing or for the immediate possession of the leased premises and all other appropriate relief. It is represented by attorney Jonathan Nicol of Kay Casto & Chaney PLLC in Charleston.
