WEST UNION – A trustee alleges an oil and gas company did not restore a property per their agreement.
James T. Nutt, trustee of the Tobey Lynn Nutt declaration trust, filed a complaint on Oct. 31 in Doddridge Circuit Court against Markwest Liberty Midstream and Resources alleging breach of agreements.
According to the complaint, the parties entered into several agreements for a permanent right of way and easement for an oil and gas pipeline. The plaintiff alleges that he has suffered damages to its property due to defendant's failure to restore it to its approximate natural elevation and contour. The plaintiff holds Markwest Liberty Midstream and Resources responsible because the defendant allegedly failed to complete the center access road, failed to properly plant the right of way and failed to complete the road extension.
The plaintiff seeks injunctive orders for the defendant to cease any activities, direct and consequential damages, attorney's fees, costs and such other just and proper relief. The plaintiff is represented by O. Gay Elmore Jr. in Charleston.
