Husband, wife blame motorist for crash that caused injuries

WHEELING — An Ohio County couple is suing a motorist, alleging the defendant's negligence led to a crash that injured the plaintiffs. 

Jon E. Berardinelli and Jan B. Berardinelli filed a lawsuit Oct. 31 in Ohio Circuit Court against Faith C. Peyton, alleging the defendant failed to maintain proper control of her vehicle.

According to the complaint, on Oct. 12, 2015, Jon Berardinelli was safely and lawfully operating his motor vehicle on Bank Street in Wheeling when Peyton recklessly entered the same street and struck the plaintiff's vehicle. 

As a result of the collision, the suit says, the Berardinellis sustained personal injuries and damages resulting in medical expenses, pain and suffering, mental anguish, loss of enjoyment of life and loss of the use of their vehicle. The plaintiffs allege Peyton failed to yield right of way, failed to keep proper lookout and failed to safely operate her vehicle.

The Berardinellis seeks trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees, costs of court and all other just and proper relief. They are represented by attorneys Justin J. Wiater and Robert J. Fitszimmons of Fitszimmons Law Firm PLLC in Wheeling.
