Residents, families accuse assisted living facility of deceptive practices

BECKLEY — Raleigh County residents and families are suing an assisted living facility, alleging unfair and deceptive trade practices.

Louise McGraw, by and through her daughter Nancy Reuschel as power of attorney and Charlotte Rogers, by and through her daughter Loretta Holcomb as power of attorney filed a class action lawsuit, individually and on behalf of all others similarly situated, Oct. 25 in Raleigh Circuit Court against Chancellor Senior Management Ltd., alleging violation of the Consumer Protection Act.

According to the complaint, the plaintiffs suffered economic losses for not getting the value of what they were promised and for what they paid for and due to defendant's understaffing. The suit says the residents also suffered malnutrition, dehydration, personal injuries and emotional distress. 

The plaintiffs allege Chancellor Senior Management failed to have sufficient staff to meet the needs of its residents, failed to properly supervise residents suffering from confusion and failed to properly train staff on Alzheimer's and dementia.

The plaintiffs seek trial by jury, declaration the defendant's business practice is based on corporate profit goals, enjoining the defendant from engaging in business based on corporate profit, compensatory damages, attorney fees, court costs and all other proper relief. They are represented by attorney Jonathan R. Mani of Mani, Ellis & Layne PLLC in Charleston.
