Motorist, blames truck owner, driver for crash

CHARLESTON — A Kanawha County motorist is suing a truck owner and driver, alleging their negligence led to injuries for the plaintiff. 

Wayne Hayes filed a lawsuit Nov. 1 in Kanawha Circuit Court against Aon Risk Services Inc. Asplundh Tree Expert Co. and Timothy Taylor, alleging Aon negligently entrusted the vehicle to Taylor.

According to the complaint, on Nov. 19, 2014, Hayes was lawfully driving his Jeep Wrangler and was stopped in traffic on state Route 119 in Charleston. Without warning, the suit says, Taylor, who was driving a truck owned by Aon and utilized by Asplundth, violently struck the rear of Hayes' vehicle.

The lawsuit states the collision caused Hayes' vehicle to strike the car in front of him, leading to substantial damages and injuries for the plaintiff. The plaintiff alleges Taylor failed to operate the vehicle in a safe and responsible manner and failed to maintain proper control of the vehicle.

Hayes seeks trial by jury, judgment against the defendants, jointly and severally for all damages, pre- and post-judgment interest, attorney fees and expenses and all other amounts allowed by law.
