Woman alleges hazardous condition at Weirton Kroger caused fall

NEW CUMBERLAND – A Weirton woman alleges she fell and was injured in a grocery store.

Louise Depoy filed a complaint on Nov. 2 in Hancock Circuit Court against The Kroger Co. alleging that the grocery store operator permitted the dangerous condition to exist.

According to the complaint, the plaintiff alleges that on Feb. 2, while she was utilizing the entranceway at defendant's grocery store in Weirton, she fell due to hazardous condition causing her to sustain severe and disabling injuries. She claims she incurred pain and suffering, mental anguish and medical expenses.

The plaintiff holds The Kroger Co. responsible because the defendant allegedly failed to inspect the premises, failed to maintain the premises in a safe condition and failed to warn of the said dangerous condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant for all damages, with pre- and post-judgment interest, costs and for such other just and proper relief. She is represented by Kevin M. Pearl of Frankovitch, Anetakis, Colantonio & Simon in Weirton.
