Greenbrier Minerals accused of not hiring Logan County man because of race, age

LOGAN – A Logan County man alleges he was not hired for a warehouse position because of his age and race.

Kerry Walker filed a complaint on Nov. 2 in the Logan Circuit Court against Greenbrier Minerals alleging violation of the West Virginia Human Rights Act.

According to the complaint, Walker was employed by Advanced Logistics as a warehouse operations supervisor beginning in 2011, and worked as a contractor for Cliff's Logan County Coal.

The suit states Cliff's Logan County Coal was sold to the defendant in December 2014 and all Advanced Logistics Inc. employees were informed they would be terminated in March 2015. These employees allegedly applied for positions with the defendant, including the plaintiff.

The plaintiff holds Greenbrier Minerals responsible because the defendant allegedly refused to hire him and instead hired his co-workers with less experience and qualifications. He alleges he was not hired because of his age and because of his race.

The plaintiff requests a trial by jury and seeks compensation for all damages, prejudgment interest, attorney's fees and costs and such other just and equitable relief. He is represented by Steven S. Wolfe and J. Christopher White of Wolfe, White & Associates in Logan. The case has been assigned to Circuit Judge Eric H. O'Briant.
