Driver blames vending company, employee for crash

HUNTINGTON — An Ohio woman is suing a vending company and one of its employees, alleging their negligence caused a crash that injured the plaintiff.

Deborah Ann Stewart of Chesapeake, Ohio, filed a lawsuit Nov. 2, in the Cabell Circuit Court against Brian Jason Fitzgerald and Kwik Kafe Vending Co. Inc., alleging Kwik Kafe negligently entrusted a company van to Fitzgerald.

According to the complaint, on Nov. 17, 2014, Stewart was driving a 2000 Chevrolet Impala east on Fifth Avenue in Huntington. The suit says Fitzgerald, who was operating a cargo van owned by Kwik Kafe, caused it to collide with Stewart's car.

The lawsuit states Stewart sustained injuries to her head, neck, body and limbs, necessitating painful, extensive and expensive medical care and treatment. The plaintiff alleges Fitzgerald failed to properly maintain control of the tractor van.

Stewart seeks trial by jury, judgment in excess of the jurisdictional limit, plus interest and court costs. She is represented by attorney Jason A. Leasure of Vital & Vital LC in Huntington.
