Customer blames parking lot owners for injuries

LOGAN — A Logan County woman is suing the owners of a local shopping center parking lot, alleging their negligence caused the plaintiff to suffer injuries.

Pamela L. White filed a lawsuit Nov. 3 in Logan Circuit Court against Fountain Place Shopping Center LLC and Real Estate Resources Inc., alleging they breached their duty to keep their property in reasonably safe condition.

According to the complaint, on Nov. 8, 2014, White and her daughter were shopping at RYE 21 inside the defendant's shopping plaza in Logan. While walking across the parking lot, the suit says, White tripped and fell on a large, broken and uneven section in the parking lot, causing her to suffer injuries, including a broken leg. 

The plaintiff alleges the defendants failed to fix the hidden dangerous condition on its property, failed to warn White of the dangerous condition and negligently allowed a hidden trap to exist on its premises.

White seeks trial by jury, judgment against the defendants, jointly and severally for all her injuries and damages, court costs, attorney fees, and all other just and proper relief. She is represented by attorneys S. Brooks West II and Nathan J. Chill of West Law Firm LC in South Charleston.
