Tire distributor alleges Putnam County couple owes $48,000

WINFIELD — A tire distributorship is suing a Putnam County couple and their business, alleging breach of contract in failing to pay more than $48,000.

American Tires Distributors Inc. filed a lawsuit Nov. 3 in Putnam Circuit Court against Eddie Smith and Diana J Smith, doing business as E&S Services, also known as Eddie Valvoline Express Lube 2 of Poca, West Virginia, alleging failure to perform their obligations under the credit application with a security and guaranty agreement.

According to the complaint, the defendants received credit from American Tires wherein they made various purchases in the sum of $48,007. The plaintiff alleges the defendants have failed and refused to pay their indebtedness.

American Tire Distributors seeks trial by jury, judgment of $48,007, plus pre- and post-judgment interest and court costs. It is represented by attorneys James B. Atkins, Paul S. Atkins and Bree Whipp Ogle of Atkins & Ogle Law Offices LC in Buffalo.
