Chimney business owner alleges he is still entitled to disability benefits

KINGWOOD – A Preston County man alleges he remains disabled because of shoulder injuries and that his disability benefits were wrongfully terminated.

Michael Adams and Spike's Chimney Sweep LLC filed a complaint Nov. 4 in Preston Circuit Court against Brickstreet Mutual Insurance Co. and Sushil M. Sethi MD PA Inc. alleging fraudulent conduct.

According to the complaint, Adams suffered shoulder injuries in 2013 and 2014 that required surgeries. The suit states his treating physician sent Brickstreet his medical information, including his limitations, for disability benefit purposes. Brickstreet later scheduled an examination for Adams with Sethi, and Sethi determined that Adams could return to work full duty. Brickstreet then allegedly terminated Adams' disability benefits, but Adams alleges he is still disabled.

The plaintiffs seek judgment against defendants, jointly and severally in an amount in excess of the minimum jurisdictional limits of the court, pre- and post-judgment interest, attorney fees and all other relief. They are represented by attorney Steven L. Estep of Estep & Shaffer LC in Kingwood. The case has been assigned to Circuit Judge Lawrance S. Miller Jr.
