Worker alleges long-term disability benefits were wrongfully terminated

CHARLESTON – A former Charleston Area Medical Center employee alleges his disability benefits were wrongfully terminated.

Douglas Hughes filed a lawsuit Nov. 7 in Kanawha Circuit Court against Standard Insurance Co., alleging that the plan administrator breached the terms of the employee welfare benefit plan.

According to the complaint, Hughes stopped receiving his benefits under the defendant's long-term disability plan. The plaintiff alleges the defendant capriciously cut off his entitlement to disability benefits and denied his appeal for such benefits.

Hughes seeks recovery of all unpaid benefits due him, prejudgment interest, attorney fees and costs for the suit and all other relief the court deems appropriate. He is represented by attorneys John J. Polak of Atkinson & Polak PLLC in Charleston, and by Matthew M. Hatfield of Hatfield & Hatfield PLLC in Madison. The case has been assigned to Circuit Judge James C. Stucky.
