Wheeling couple accuses Pittsburgh firm of legal malpractice

WHEELING – Two estate executors allege a Pittsburgh law firm failed to adequately represent them in two legal matters.

Mary Camastro and Vince Camastro of Wheeling, individually and as executor of the estate of Dante Camastro, filed a lawsuit Nov. 7 in Ohio Circuit Court against Willman R. Silvaggio LLP, Joseph Silvaggio and Terrence Henne, alleging legal malpractice.

According to the complaint, the defendants represented the Camastros in two civil actions regarding property damage and personal injuries. The suit states the defendants withdrew as counsel in the cases in November 2014 after the plaintiffs refused to settle the suits. The plaintiffs allege as a result of defendants' actions, they sustained substantial costs and delays in their case, expended monies in excess of $64,000 for their new counsel and settled their claims in a sum of money far below the reasonable value.

The plaintiffs allege the defendants failed to properly prepare to strengthen plaintiffs' case, failed to properly inform them of the development of their case and failed to pursue their wrongful death claim of Dante Camastro.

The Camastros seeks trial by jury, compensatory damages, punitive damages, attorney fees and court costs. They are representing themselves. The case has been assigned to Circuit Judge James P. Mazzone.
