HUNTINGTON — A Charleston woman is suing a Cabell County health care provider, alleging the defendant's negligence led to injuries for the plaintiff.
Virginia L. Dolin filed a lawsuit Nov. 9 in Cabell Circuit Court against St. Mary's Medical Center Inc., alleging medical malpractice in failure to render care and services in a prudent and safe manner.
According to the complaint, on Oct. 8, 2015, Dolin awoke and attempted to use the restroom in her room at St. Mary's Medical Center. However, due to sedation and her inability to ambulate, the suit says, Dolin fell on the floor, resulting in severe and disabling injuries that required two surgical procedures and incurred additional medical expenses of $66,294.07. The lawsuit states she has suffered additional pain and mental anguish.
The plaintiff alleges St. Mary's Medical Center negligently moved the additional barriers placed by her daughter on her bed, lowered the rails to her bed and disconnected the safety alarm.
Dolin seeks trial by jury, judgment in an amount that will fairly compensate for her damages including past and future medical expenses, punitive damages and all other appropriate relief. She is represented by attorney Travis A. Griffith of Griffith Law Center PLLC in Charleston.
