Assistant manager accuses Home Depot of wrongful termination

CLARKSBURG — An Upshur County woman is suing Home Depot, alleging disability discrimination, retaliation and wrongful discharge.

Samantha Claypool filed a lawsuit Nov. 10 in U.S. District Court for the Northern District of West Virginia against Home Depot USA Inc. and David Puhlman, alleging violation of the Family Medical Leave Act and the West Virginia Human Rights Act.

According to the complaint, on June 17, Claypool was terminated from her employment as an assistant operations manager at a Home Depot store in Bridgeport when she was eight months pregnant and after she had requested to take FMLA leave. The suit says Claypool, who had worked at Home Depot for eight years, suffered lost wages and benefits, emotional distress, loss of dignity and aggravation. 

The plaintiff alleges the defendants treated her differently and retaliated when she exercised her rights under the FMLA and terminated her employment after she had given a discount on damaged merchandise to a customer who was not related to her.

Claypool seeks trial by jury and seeks, actual and liquidated damages, attorney fees, court costs, pre- and post judgment interest, and all other relief that is proper. She is represented by attorneys Maria W. Hughes and Mark Goldner of Hughes & Goldner PLLC in Charleston.
