CHARLESTON — A Roane County property buyer is suing real estate brokers and a contractor, alleging breach of contract and negligence.
Chester Ellison Jr. filed a lawsuit Nov. 2 in Kanawha Circuit Court against Board-Depue Realty Company LLC, Crown Development LLC and Jennifer S. Nichols, alleging they failed to perform their contractual obligations.
According to the complaint, on Nov. 13, 2015, Ellison purchased property in Reedy advertised by Nichols and Board DePue. Shortly after taking possession of the property at 2174 Middle Fork Road, the suit says, Ellison began to notice deficiencies on the home.
The lawsuit states Ellison contacted Crown Development to do repair work but after completion of the work, the problems persisted. The plaintiff alleges Nichols and Board DePue represented that the home was a turnkey purchase and Crown Development breached the agreement by failing to make repairs in a workmanlike manner.
Ellison seeks trial by jury, judgment in an amount sufficient to compensate him for damages, pre- and post judgment interest, costs and attorney fees and all other just relief.
