Parents, brother blame Charleston police for man's death

CHARLESTON — Parents and a brother are suing the Charleston police, alleging their negligence led to the death of a family member.

James Earl Gore Jr. and Lucille Dabney Gore of Houston, and Bradford Allen Gore of Kanawha County filed a lawsuit Nov. 4 in Kanawha Circuit Court against the Charleston Police Department, alleging it breached its duty by not giving assistance to a suicide victim.

According to the complaint, on Jan. 1, 2016, the plaintiffs son/brother James Gore III attempted to commit suicide. The suit says due to the Charleston police's interference with the paramedics, Gore was later pronounced dead at CAMC General Hospital.

The plaintiffs allege that instead of allowing paramedics immediate access to James Gore III for medical attention, the Charleston police took pictures of him while Gore was still alive and did not investigate the cause of his death.

The Gores seek trial by jury, compensation of no less than $10 million, and any other appropriate relief. They are represented by attorney Christina Kostenko of Coal County Law Firm in Daniels.
