Employee accuses Jackson County of wrongful discharge

RIPLEY — A Ravenswood man is suing a Jackson County company, alleging age discrimination, retaliation and wrongful discharge.

Steven R. Peery filed a lawsuit Nov. 15 in Jackson Circuit Court against Constellium Rolled Products Ravenswood LLC, alleging violation of the West Virginia Human Rights Act.

According to the complaint, on Nov. 18, 2015, Peery  was terminated from his employment for claiming a compensable work-related injury regarding work boots that were too small and due to his age--older than 40. As a result, the suit says, Peery has suffered past and future lost wages and benefits, emotional distress, aggravation and annoyance. 

The plaintiff alleges the defendant wrongfully terminated his employment and replaced him with a younger employee.

Peery seeks trial by jury, compensation for actual and punitive damages, attorney fees and all other relief the court deems just. He is represented by attorney Scott H. Kaminski of Kaminski Law PLLC in Charleston.
